You may browse our Website, request a quote, and use our online tools (including the Instant Quote Calculator) for personal, non-commercial use related to your own potential painting project. You agree not to:

Attempt to interfere with the Website's operation, security, or other users' experience.
Copy, scrape, redistribute, or commercially exploit our content without our written permission.
Submit false or misleading information through any of our forms.

Estimates and quotes

Our Instant Quote Calculator and any online or verbal cost ranges we provide are estimates only, based on typical pricing for projects of a similar scope. They are not binding offers and they don't form a contract.

A binding price applies only when we issue a written quote after an on-site visit and you accept it in writing (including by email). Written quotes are valid for the period stated on the quote, typically 30 days. After that, prices may change to reflect updated material costs or scheduling.

Booking, deposits, and payment

Project booking is confirmed when you sign and return our written quote and any deposit required is received.
Deposit amount and payment milestones are set out in the written quote for your project.
Final payment is due upon completion and a satisfactory walkthrough, unless other terms are stated in writing.
Late payments may be subject to interest as permitted by Ontario law.

Workmanship and warranty

We stand behind our work. Specific warranty terms (length and coverage) are stated in the written quote for each project. In general:

We warrant that the work will be performed in a competent, professional manner using suitable materials.
Warranty coverage applies to defects in workmanship that arise within the warranty period and excludes damage from settlement, water intrusion, normal wear, abuse, alterations, or causes outside our control.
To make a warranty claim, contact us in writing within a reasonable time of discovering the issue.

Client responsibilities

To help your project go smoothly, you agree to:

Provide accurate information about the property, scope, and access.
Ensure safe access to all work areas during scheduled hours.
Disclose known issues (lead paint, mould, structural concerns, etc.) before work begins.
Make payments per the agreed schedule.

Photos and portfolio use

We sometimes photograph completed projects for our portfolio, website, and social media. Unless you opt out in writing before or shortly after your project, you grant us a non-exclusive licence to use those project photos for marketing purposes. We will not publish personally identifying information about you or your home (like your address or name) without your explicit consent.

Intellectual property

All content on this Website — text, images, photographs, branding, code, design, and the Instant Quote Calculator logic — is owned by Sigma Painting or our licensors and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Disclaimers

The Website and any tools we offer (including the Instant Quote Calculator) are provided “as is” and “as available” without warranties of any kind, express or implied. While we work hard to keep information accurate and up to date, we don't guarantee that Website content is error-free or that the Website will be uninterrupted.

Cost estimates produced by the calculator are not binding quotes and may differ significantly from final on-site quotes depending on conditions we discover during the in-person visit.

Limitation of liability

To the maximum extent permitted by law, Sigma Painting's total liability arising out of or relating to your use of the Website is limited to one hundred Canadian dollars (CAD $100). Liability for our painting Services is governed by the written quote and contract for your project and by applicable Ontario law.

We are not responsible for indirect, incidental, special, or consequential damages, including lost profits, lost opportunities, or damage to data, even if we've been advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Third-party links and content

Our Website may link to third-party websites — paint manufacturers, review platforms, social media, etc. We don't control those sites and aren't responsible for their content or practices. Following an external link is at your own discretion.

Indemnity

You agree to indemnify and hold Sigma Painting harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Website, your violation of these Terms, or your violation of any third-party rights.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. You and Sigma Painting agree that the courts of Ontario have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Services, subject to any consumer protection rights you may have to bring an action in your home province.

We may update these Terms from time to time. When we do, we'll update the “Effective” date at the top of this page. Continued use of the Website after changes are posted means you accept the updated Terms.

Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms remain in full effect.
